1. Definitions
- "Carer" means the parent, legal guardian, or designated adult attending the Course (or any part of it) with the Pupil.
- "Coach" means the individual(s) employed or contracted by Gymnathlon to teach the Course.
- "Course" means the Gymnathlon sports program, trial lesson, or course enrolled upon.
- "Enrolment Form" means the online registration form completed by the Parent to register a Pupil.
- "Fee" means the monetary cost per Course or session as specified during enrolment.
- "Gymnathlon" means Gymnathlon Ltd. (Company No. 16921747), registered at Clerkenwell House, 45-47 Clerkenwell Green, London, England, EC1R 0EB.
- "Parent" means the parent or legal guardian responsible for paying the Fees and entering into this contract.
- "Premises" means the venue or facility where the Course takes place.
- "Pupil" means the child attending the Course, as specified on the Enrolment Form.
- "Terms" means the terms and conditions set out in this document.
- "Writing / Written" includes electronic communication via email.
2. Acceptance of Terms and Conditions
- 2.1 Please read these Terms carefully before booking. They set out who we are, how we provide classes, how the contract may be changed or ended, and what to do if there is a problem.
- 2.2 The Terms are deemed accepted by the Parent upon completion of the Enrolment Form and payment of the Fee (or payment made by a Carer on the Parent's behalf).
- 2.3 No variation or addition to these Terms shall be binding unless agreed to in writing by Gymnathlon Ltd.
- 2.4 Confidentiality & IP Protection: The Parent and Carer agree to keep the content, structure, and methodology of the Gymnathlon Training Programme confidential. You agree not to copy, reproduce, or use any aspect of the Gymnathlon programme for commercial purposes, nor directly or indirectly operate or assist a competing business during enrolment and for two (2) years thereafter.

4. Booking, Payments & Money-Back Guarantee
4.1 Bookings
- 4.1.1 Bookings are made online at www.gymnathlon.co.uk.
- 4.1.2 Timetables and locations are correct at the time of publication. In the event of time or location updates, we will notify you as early as possible.
4.2 Payments
- 4.2.1 Course fees must be paid in advance according to the payment schedule selected at checkout.
- 4.2.2 Online payments are processed securely via third-party providers (e.g., Stripe, PayPal). Gymnathlon does not store full payment card details.
4.3 100% Money-Back Guarantee & Cancellation Policy
Statutory consumer cancellation rights do not apply to scheduled recreational sports classes. Instead, Gymnathlon offers the following cancellation and refund rules:
- First Session Guarantee (100% Refund): If your child is not thrilled after their 1st session, you are entitled to a 100% refund. To claim this, you must submit a written cancellation request within 72 hours of the 1st session taking place.
- Cancellation within 72 hours of the 2nd session: 75% refund of the paid fee.
- Cancellation within 72 hours of the 3rd session: 50% refund of the paid fee.
- More than 72 hours after the 3rd session: No refunds will be issued.
Refund calculations are based on the total number of sessions conducted in the term/course to date, regardless of the child's actual attendance. Cancellation requests must be submitted via the designated online form.
5. Cancellations & Class Changes by Gymnathlon
- 5.1 Venue / Coach Changes: While we aim to maintain consistent coaching teams, Gymnathlon reserves the right to substitute coaches or make reasonable venue adjustments when necessary.
- 5.2 Session Cancellations: If a session is cancelled by Gymnathlon due to unforeseen coach illness or facility issues, a make-up class, online replacement, or account credit will be provided.
- 5.3 Force Majeure & Extreme Events: If live classes are suspended due to events beyond our reasonable control (e.g., severe weather, government restrictions, facility closures, public health guidance), Gymnathlon reserves the right to deliver sessions online or reschedule classes. No cash refunds will be issued under such extreme circumstances.
6. Attendance & Missed Classes
- 6.1 Payments reserve a specific place for your child. Missed classes cannot be refunded or credited due to individual absence, sickness, or holidays.
- 6.2 Where available, Gymnathlon may offer options for alternative catch-up sessions, subject to venue availability and prior administrative approval.
7. Parent & Carer Responsibilities
7.1 Health & Safety Warranties
- 7.1.1 The Parent warrants that all information submitted on the Enrolment Form is accurate and up to date, including any medical or developmental conditions.
- 7.1.2 Neither the Pupil nor the Carer shall attend any class if suffering from any contagious illness or injury that may put others at risk.
7.2 Supervision & Conduct
- 7.2.1 Parents/Carers remain responsible for the safety, welfare, and behavior of their child at all times on the Premises, including before and after the session.
- 7.2.2 Respectful and civil behavior toward Coaches, staff, venue representatives, and other families is required at all times. Gymnathlon reserves the right to exclude any individual whose behavior is deemed unacceptable or disruptive.
- 7.2.3 Equipment & Footwear: Children must wear suitable athletic clothing and proper sports footwear.
- 7.2.4 Safeguarding & Photography: To comply with our Child Protection Policy, photography and video recording by parents/carers during classes are strictly prohibited unless explicit written permission is granted by Gymnathlon management.
8. Limitation of Liability
- 8.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by Gymnathlon's negligence, or any statutory rights that cannot be excluded under English law.
- 8.2 Subject to clause 8.1, Gymnathlon, its coaches, employees, and agents shall not be liable for any indirect or consequential loss, damage, or expense suffered by the Parent or Pupil.
- 8.3 Gymnathlon’s maximum aggregate liability to the Parent or Pupil for any claim arising under these Terms shall not exceed the total Fee paid by the Parent for the relevant Course.
9. Data Protection & Privacy
Personal data provided during enrolment is processed in accordance with the UK GDPR, the Data Protection Act 2018, and our full Privacy Policy.
10. Complaints Procedure
If you are unhappy with any aspect of our service, please follow these steps:
- Speak directly with the lead Coach or local coordinator to resolve the matter on-site.
- If unresolved, submit your complaint in writing to info@gymnathlon.co.uk. Management will review and respond within 14 working days.
11. Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with English Law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
